“WEET-BIX SUMMER” PROMOTION
TERMS AND CONDITIONS
1. Instructions on how to claim and the offer form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.
2. Claims are only open to Australian residents (Claimants).
3. Promotion commences on 01/11/2011 and claims close at 11:59pm AEST on 01/06/2012 (Promotional Period). Claimants will be notified writing. The Promoter’s decision is final and no correspondence will be entered into.
4. To claim, Claimants must, during the Promotional Period, purchase any two (2) specially-marked 1.2kg Weet-Bix boxes from participating Woolworths’ stores. Claimants must then collect the unique code found inside each Weet-Bix box. Claimants who have collected two (2) unique codes must, during the Promotional Period, visit www.weet-bix.com.au, follow the prompts to the promotion claim page, input the requested details including the two (2) unique codes, and submit the fully completed claim form.
5. The Promoter reserves the right, at any time, to verify the validity of claims and Claimants (including a Claimant’s identity, age and place of residence) and to disqualify any Claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6. Incomplete, indecipherable or illegible claims will be deemed invalid.
7. Multiple claims permitted, subject to the following: (a) only one (1) claim permitted per specified purchase requirement; (b) each claim must be submitted separately and in accordance with claim requirements; (c) only two (2) unique codes per claim are permitted; (d) the same unique code cannot be used more than once; (e) unrecognised codes will be deemed invalid.
8. Each valid claim received will be awarded a promotional code which permits the Claimant to receive a $10.00 discount off the cost of registration for a Sanitarium Weet-Bix Kids TRYathalon (Discount). To redeem a Discount, Claimants must visit www.tryathlon.weetbix.com.au, follow the prompts to the registration page, input the requested details including the promotional code when promoted, and submit the fully completed registration form. A Discount will only be valid for Sanitarium Weet-Bix Kids TRYathalons which remain open at the time of redemption by the Claimant and will only be valid for the 2012 series.
9. Maximum of one (1) Discount redeemable per Sanitarium Weet-Bix Kids TRYathalon registration. A Discount cannot be used more than once and unrecognised Discounts will be deemed invalid.
10. Any ancillary costs associated with redeeming a Discount are not included. Any unused balance of a Discount will not be awarded as cash. Redemption of a Discount is subject to any terms and conditions of the issuer and Sanitarium Weet-Bix Kids TRYathalon organisers, including those specified at www.tryathlon.weetbix.com.au.
11. If an offer is unavailable, the Promoter, in its discretion, reserves the right to substitute the offer with an offer to the equal value, as appropriate.
12. Offers are not transferable or exchangeable and cannot be taken as cash.
13. Any cost associated with accessing the promotional website is a Claimant’s responsibility and is dependent on the Internet service provider used.
14. The use of any automated entry software or any other mechanical or electronic means that allows a Claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that Claimant invalid.
15. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
16. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
17. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim or offer that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in offer value to that stated in these Terms and Conditions; (e) if a Sanitarium Weet-Bix Kids TRYathalon event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a Claimant; or (g) use of the offer.
18. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, offer suppliers and, as required, to regulatory authorities. Claim is conditional on providing this information. Claimant should direct any request to access, update or correct information to the Promoter. All claims become the property of the Promoter.
